By virtue of that which is established in article 10.1.c) EGEDA is an intellectual property rights management association authorized by the Ministry of Culture under Ministerial Order of 29th October 1990, published in the Boletín Oficial del Estado (Official State Gazette) number 263 of 2nd November 1990.

The Articles of Association and By-Laws of EGEDA were submitted on 14 September 1990 to the Servicio de Depósito de Estatutos de la Subdirección General de Programación y Actuación Administrativa de la Dirección General de Trabajo (“Statutes Deposit Service of the General Sub-Department of Administrative Scheduling and Action of the Department for Employment”) and this deposit was published in BOE number 258 of 27th October 2005.

In accordance with the provisions of the Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal(Organic Law 15/1999 of 13th December on Personal Data Protection), users are hereby advised of the existence of an automated file containing their personal data named “USARIOS” (USERS), the purpose of which is to manage the activity of the web portal (making audiovisual content available) and to provide registered users with information about the services offered by FILMOTECH.COM.

This file has duly been registered in the Registro General de Protección de Datos de carácter personal (Spanish General Register of Data Protection) and the security measures established under Real Decreto 1720/2007, de 21 de Diciembre (Royal Decree 1720/2007 of 21st December) have been implemented.

Your submission of the personal data requested by FILMOTECH.COM is obligatory for registering as a user and gaining access to the services offered by the portal, and for receiving information about same. In particular, users are hereby informed that the IP address from which the connection is established when the user logs in or uses a viewing code will be saved and stored.

Failure to provide the personal data requested or non-acceptance of this data protection policy will mean it is impossible for you to subscribe to, register for or receive information from these services. We hereby inform you that the personal data you provide will be incorporated into the “USARIOS” (USERS) file.

FILMOTECH.COM does not handle users’ banking details itself during the payment process; these operations are performed directly by the banks and financial institutions concerned.  

The users guarantee the accuracy, validity and authenticity of the personal data they submit, and agree to keep such data up to date. The user exonerates FILMOTECH.COM from any responsibility for any harm which the user may suffer as a result of errors, inaccuracies or omissions in the information supplied to FILMOTECH.COM.

FILMOTECH.COM does not disclose personal data to third parties. However, in the event of the possibility of data disclosure arising in any particular situation, a prior communication will be issued requesting the express consent of the affected party, and unless this is duly given absolutely no such disclosure will be made.

A) To access filmotech.com content it is necessary to register as a user. There are two ways of accessing the audiovisual content available on filmotech.com:

1. FILMOCLUB MONTHLY RATE: By subscribing to our flat rate monthly service users can see films from the FILMOTECH.COM catalogue for one month starting the day the subscription is taken out.

2. ACCESS TO FILMS ON AN INDIVIDUAL BASIS: Users can view any of the films and audiovisual content available on FILMOTECH.COM individually. Access to each film will be granted for a period of 48 hours starting from the first viewing.

B) The price for accessing a film on an individual basis will be either 1.95 € or 2.95€, as specified in the film file; this price includes VAT in both cases. If the user wishes to watch a series, the price for renting each episode individually including VAT will be 0.95€ or 0.50€, depending on the series concerned. If the entire series or one season of a series is rented, the price will be 0.95 €, 1.95 €, 2.95 €, 4.95 € or 10.95 €, as specified on the series file.

C) The flat rate service costs 6.95 € per month including VAT.

D) Users can choose between two different payment options:

1. PAYMENT BY CREDIT CARD. Users can pay with their credit cards by bank transfer.

2. PAYPAL: With this payment channel, users can pay with their credit cards or through their personal PayPal accounts. On first contracting the services of FILMOTECH.COM, the user authorizes corresponding payment according to the rates in force at any given time, on an individual basis or on a monthly basis, and any other charge incurred by the user with relation to use of FILMOTECH.COM services duly indicated on the website or established by the holder of the payment system through the Payment Option indicated when registering.

E) Once payment has been processed, FILMOTECH.COM will grant you a non-exclusive, non-transferable licence to view its digital content via streaming. Only private use is authorized, and FILMOTECH.COM’s services may not be used for direct or indirect commercial purposes.

F) The digital content diffusion service may automatically download and install updates of FILMOTECH.COM or, depending on the user’s browser, do so by means of plug-ins or add-ons. These updates are designed to improve, extend and develop the services and may take the form of solutions, enhanced functions and completely new versions. The user, on accessing the services of FILMOTECH.COM, thereby consents to receiving such updates. Once the updates have been provided the user shall assume the responsibility of installing them in order to access the services of FILMOTECH.COM without problems.

Whichever service the user chooses (monthly rate or individual) viewing will take place via streaming and the downloading of the works made available on filmotech.com is strictly prohibited.

Attempting to access the filmotech.com services by any means other than the interface provided by FILMOTECH.COM is expressly prohibited, as is attempting to evade the limitations of use or access which have been established to prevent certain uses of the Services.

Immoderate or abusive use of the account or user code, or their use in a way incompatible with or in excess of the possibilities offered by filmotech.com, will result in the subscription being suspended.

For security reasons an IP address control has been set up to check the IP addresses which each user may use, so that if the username and password is used from over 5 different IP addresses the system will produce an alert and suspend the viewing of works from this account. Viewing may then be enabled, where applicable, by the system administrator.

The content, texts, designs, logos, source codes, and any intellectual creation existing on FILMOTECH.COM are protected by Intellectual Property legislation. Said legislation is included in the Texto Refundido de la Ley de Propiedad Intelectual (Spanish Intellectual Property Act – Collected Text), approved by Real Decreto Legislativo 1/1996, de 12 de abril (Spanish Legislative Royal Decree of 12th April), amended by Ley 23/2006, de 7 de julio (BOE, Spanish “Official Gazette” of 8th July) which incorporates Directive 2001/29EC, on the harmonisation of certain aspects of copyright and related rights in the information society into Spanish law.

The possible presence of distinctive titles under other ownership and the inclusion of works which are the property of others have been carried out with prior authorization from their rightful owners.

FILMOTECH.COM is a registered trademark protected by Law.

Any Software available via the Services is the property of FILMOTECH.COM and its suppliers. Where the Software or streaming service made available via the Services is accompanied by license terms, the use of such software is governed by the terms and conditions of any license agreement that accompanies or is included with the Software, or by the license agreement expressly indicated in the hyperlinks referenced in the Software. Some license terms are posted with the Software downloads. You may not use, download or install any Software which is accompanied by or includes a license agreement unless you accept the terms of such a license agreement.
